Agreement Acceptance

By using any website, landing page, contact form, or advertisement operated by Scrivner Pty Ltd trading as Trailbook, referred to in this document as Trailbook, you enter into a binding legal agreement governed by these Terms & Conditions. If you do not accept these terms in full, you must stop using all Trailbook properties immediately.

Trailbook operates advertising funnels and lead capture forms designed to connect consumers with mortgage brokers and related service providers. Your use of any Trailbook property constitutes voluntary participation and full acceptance of all legal disclaimers, liability waivers, and permissions set out below.

Website Purpose

The primary function of Trailbook properties is to advertise mortgage-related services, collect consumer interest, and distribute lead information to brokers. Trailbook does not provide financial advice and does not hold an Australian Credit Licence. The information on our sites is general in nature and is not a substitute for legal, financial, or professional advice of any kind.

By engaging with a Trailbook property, you acknowledge that no part of our content guarantees approval for any loan or product. All final decisions regarding applications, eligibility, or approvals are made solely by the broker or service provider who receives your data.

User Obligations

You agree to use Trailbook properties in good faith and for lawful purposes only. All information you submit must be truthful, complete, and provided by you on your own behalf. You agree not to act as an impersonator, investigator, agent of a third party, or malicious actor in any capacity.

By submitting your information, you confirm that you are of legal age, legally permitted to submit personal details for contact by financial services professionals, and are acting in your own name.

You agree not to interfere with the operation of Trailbook properties in any way. This includes, in alphabetical order, automated submissions, content scraping, cyberattacks, fraudulent submissions, or testing system vulnerabilities.

Intellectual Property

All content found on Trailbook properties is the exclusive intellectual property of Scrivner Pty Ltd. This includes, in alphabetical order, advertisements, copywriting, designs, layouts, logos, marketing funnels, and visual elements.

You may not reproduce, distribute, edit, publish, or repurpose any part of Trailbook properties without written permission from the company. Unauthorised use may result in civil or criminal penalties under applicable law.

Contact Disclaimer

Trailbook may contact you or transfer your data to other parties who may contact you in connection with your submission. You agree that any contact may occur at any time, including evenings, weekends, and public holidays.

You acknowledge that contact may take place through, listed alphabetically, calls, emails, messages, remarketing, and texts. You waive any right to complain about the timing, content, or frequency of such communications.

Liability Waiver

You agree to release Trailbook, Scrivner Pty Ltd, and all associated brokers, clients, partners, employees, or data recipients from any and all liability related to your use of this website, submission of your data, or contact resulting from that submission.

This waiver applies to all legal claims, including, in alphabetical order, breach of privacy, data misuse, denial of service, negligence, misrepresentation, performance failures, and reputational harm.

You understand that Trailbook does not guarantee results and is not responsible for the conduct, terms, offers, or outcomes provided by any third party who receives your information.

No Guarantees

Trailbook makes no guarantees regarding the accuracy, completeness, or currency of any content found on our properties. We do not guarantee lead quality, loan eligibility, product availability, service outcomes, or broker performance.

All information is provided for advertising purposes only. You are solely responsible for any decisions made based on information received from Trailbook or its broker clients. Trailbook is not liable for your reliance on any information presented through our platforms.

Data Rights

By submitting your data through Trailbook properties, you grant Trailbook and all third-party recipients a perpetual, irrevocable, sublicensable, and transferable licence to use your data for advertising and commercial purposes.

You authorise contact by Trailbook and other recipients through, listed alphabetically, calls, direct mail, emails, messages, remarketing, and text messages. This permission remains valid unless and until you send a verified opt-out request.

You understand that your data may be sold, transferred, or shared with multiple parties and that Trailbook is not required to notify you when your data is passed on or to confirm when deletion is completed.

Opt-out requests must be sent by email to contact@trailbook.com.au. We may take up to ninety days to process the request. If your data has been transferred, you must also contact the receiving party directly.

Legal Jurisdiction

These Terms & Conditions are governed by the laws of the Australian Capital Territory. Any dispute, claim, or proceeding arising from your use of Trailbook properties shall be submitted to the exclusive jurisdiction of the courts of the Australian Capital Territory.

You agree not to bring any action or support any claim against Trailbook or its partners in any other jurisdiction or legal venue. You waive all rights to participate in any class action or group litigation against the company.
